That just goes to the merits. See the OP law professor (Bernick) I quoted who has published extensively about the poor merits of Wurman’s work.

I’m just saying my Alma mater should not employ someone whose scholarship is in bad faith. Your work can be wrong on the merits but made in good faith.

Lawyers often argue “this other document sheds light on what the words of the constitution meant at the time.” In other words he disagrees that the 14th A. actually codified birthright citizenship. Common form of legal argument. His problem is just that he’s making the argument in bad faith.
