Ik bedoelde : die zegt wat waarheid is. Gezag van gewijsde houdt in dat uitspraak als waar wordt beschouwd ook al kan je tegendeel aantonen.

Bij rechten heb je wel iemand die op het einde de waarheid is (gezag van gewijsde) waarop die beslissing met overheidsgeweld wordt afgedwongen (uitvoerbare kracht). Er heeft nog nooit een filosoof zijn verzekeraar moeten bellen omdat hij ten onrechte ‘t cartesiaans substantiedualisme aanhing.
Bij juristen is onduidelijkheid vaak een strategie om aansprakelijkheid te beheersen. Je zal maar helder zeggen “het mag“ en dan blijkt het toch niet te mogen. Dus je schrijft een epistel met caveats, proviso’s en assumpties.
