Two LSPO judgments on whether notional deductions should be applied to historic costs.

In HA v EN Richard Todd KC followed the approach started by Cobb J and applied a 30% discount.

In SM v BA Nicholas Allen KC took the view it wasn’t appropriate to make such a discount as a matter of principle.

Two more reports by Fair Shares project on domestic abuse when resolving finances on divorce and regional disparities in spousal maintenance. I was struck by this finding on impact of domestic abuse on females post divorce. Such important work

Judgment of HHJ Hess dealing with valuation, categorisation and treatment of a business on divorce. On facts followed Jones approach to springboard. Also first reported decision (of which I’m aware) to refer to the provisional report of the Duxbury Working Party.

For NCDR fans note the reference in the penultimate paragraph to the judge intending to adjourn W’s set aside app to allow mediation to take place. Second time (of which I’m aware) since rules changed earlier this year (the first being NA v LA).

Latest instalment in A v M, this time H’s app to strike out W’s app to set aside Mostyn J’s final order. It follows a judgment earlier this year regarding the correct construction of Mostyn J’s order regarding W’s right to share in H’s carried interest.
