E g. The food bank here in San Diego buys bulk quantities of rice for a fraction of supermarket costs and re-packages it themselves in consumer-sized packages for distribution. Instead, these ordinances routinely define "crime" as not just a violation of a criminal statute, but also:

- changing the character of the neighborhood
- causing or permitting unreasonable or repeated use of police resources
- causing or permitting other tenants or neighbors to feel unsafe

Sheryl, you say. Crime is something that's illegal. Commit a crime and get evicted. But - and this is the important part - *that is not and has never been how these ordinances define "crime."*

And their purpose was simple: where the police determine that a crime was committed by a preponderance of the evidence, the police may require or the landlord may use that crime as a basis to evict the occupant.

Now, there's a reason people support "crime free ordinances."

But these nuisance ordinances didn't stay in NYC. By 2020, Illinois had more nuisance ordinances than any other state. By then, NYC's nuisance ordinance had developed a well earned negative reputation, so their proponents had adopted a new name for them: "crime free ordinances."

The nuisance ordinance was a smashing and racist success. Thousands of people were evicted for crimes for which they were never convicted.

Note the evidentiary standard here - not beyond a reasonable doubt, which is the standard for a criminal conviction, but instead the civil evidentiary standard of "preponderance of the evidence," which basically means, more likely than not. And the beauty of the nuisance ordinance was (Cont)

The Warren Court had just decided Miranda v. Arizona the decade before, and the NYPD thought its hands were tied by the new requirement of reading arrestees their rights.

A couple of years ago, a client of mine was attacked in their apartment by an abusive partner. The police were called. Charges were pressed against the abusive partner, who later pleaded guilty.
The landlord filed an eviction action against Client for *allowing* a crime to occur in their unit.
