The first part of a three part answer identifies if the school excludes your child they must follow certain procedures and set timeframes. The school must contact parents or carers on the day to highlight the exclusion and check it is safe to send the child home. A meeting must be arranged to discuss the exclusion within 7 days, and the school must explain in writing the reasons for exclusion and the right to appeal within 8 days of the exclusion. If these procedures are not followed, the exclusion mabe be considered to be 'unlawful'. Answer one of three.
Part two of the answer recommends working with the school to identify what led to the exclusion and what steps can be taken to avoid it happening again. It also highlights that the school may wish to draw up a plan of action and have formal agreement, by way of a signature from you or your child. Whilst this may be helpful, it is not a legal requirement for return. Answer two of three.
The final answer card reminds us that school must not send someone home as a way of managing their additional support needs. It also highlights that exclusion, particularly multiple exclusions, may be a sign that a child needs more or different support. Should this be the case there should be a discussion around the support your child is receiving (if any) and a review of any plans in place. Answer three of three.
Exclusion should only be used as a last resort - and never as a way of managing additional support needs.
