This matters for the issue of whether Wilcox and the other members exercise an executive function. If they don’t exercise executive power then the removal protections are constitutional under Humphrey’s Executor and Seila Law.

The lawyer arguing the case for Wilcox is doing a phenomenal job at dismantling the Government’s position. He’s very clear that the NLRB is a unique agency; effectively two agencies under one umbrella with prosecutorial power vested in the GC and the adjudicative function of the 5 member board.
