Last year, both pieces of legislation were amended to enable the Alberta separatists' petition and referendum, the Statement of Claim alleges. These amendments ended the 33-year requirement that constitutional referendum questions required pre-approval through a vote in the legislature. Now, the United Conservative Party (UCP) cabinet can put any constitutional question forward without going to the legislature at all- the Justice Minister can even act as a rubber stamp for the separatists' question. The Statement of Claim seeks to strike down these laws and requests that mandatory orders be issued against Alberta forcing them to comply with the constitution of Canada and the Treaties. Chief Billy-Joe Tuccaro released the following statement on the lawsuit: "We won in Court on December 5. Our evidence on Cree law was clear; any discussion of altering the Treaty relationship must involve the Treaty partners, First Nations, from the beginning. What we have here are non-Treaty partners-separatists and the UCP government-starting a process that will become increasingly difficult to stop. This case also confirmed that separation can't happen without our consent because it will change the parties to the Treaty. We know all these referenda are illegal. So, what's the point? And what happens if the US interferes?" "We will not sit back and watch as this government lays out the welcome mat for making Alberta the 51st State in breach of our Treaties." "Smith's government is deliberately trying to destroy not only our Treaties but also Canadian society, democracy and the constitution. Our Treaties rely on a stable Treaty partner, not a place where anyone's rights can be taken away by a referendum vote. They say this is democratic-but it's not democratic to use popular votes to end Treaty relationships and take away rights. There's another word for that: authoritarianism."

"We would also like to remind Premier Smith; every single non-Indigenous person in Alberta is an immigrant or descendant of immigrants. We agreed to share our land with all settlers, all human beings, regardless of race and origin of birth. And the only one we would consider revoking that promise to are those individuals in this government." Just today, the Assembly of Treaty Chiefs (AOTC) passed a non-confidence vote on the United Conservative Party government. The AOTC is a political forum for Treaty Chiefs across Treaties 6, 7 and 8 in what is now Alberta. MCFN supports this resolution. MCFN's litigation is forward looking to the referendum process. MCFN places its unwavering support behind the other litigation of Sturgeon Lake Cree Nation, Athabasca Chipewyan First Nation, and the Blackfoot Confederacy, all scheduled to be heard April 7, 8 and 9 in Edmonton.
