Where is the line? You raise larger issues. What if a beat cop gets a morning coffee from a cafe? A plain coffee. Not a $20 not a double mocha expresso drizzled coca frappachino custom deluxe. Is that a bribe? Apple would argue the same thing.

I am not sure if I agree. The language “criminal exposure” is not a term of art nor a doctrine in Corporate Law as far as I know. I don’t recall it from law school or during practice and it’s not listed in Black’s Law Dictionary 7th Ed. Apple is a business and given the difficult context is shrewd.

Don’t think it’s a crime. I have to defend both Trump and Apple here. (Cough cough). Presidents regularly receive gifts. Disclosure is the issue. Here it’s a business. For the plane it’s a FOREIGN GOVERNMENT. That’s distinguishable and very problematic. Clarence Thomas failed to disclose his gifts.

They have a legal obligation to maximize profits. What if they came “empty handed” and Trump said “screw them, buy my Trump phone” and Apple’s share price tanked and they started to loose sales? The Northstar is profits not necessarily ethics. That’s how the law is structured. It’s law school 101.

Nah. Apple is business that owes a legal duty to its shareholders only to maximize profits. Big whoop. He gave Trump a tchotchke. That is completely different than the law firms like Skadden and Paul Weiss kissing Trump’s ring. That act threatens democracy and the rule of law. Critical distinction.

What will save us is that Americans are infused with the ideals of democracy. Fragmentation will also save us. Democracy exists even at the hyper local dog catcher position. See Tocqueville’s Democracy in America. Even privately when someone uses Roberts Rules of Order, that’s democracy in action.

I haven’t seen anything lately about Justice Thurgood Marshall. His advocacy in Brown saved democracy. He was one of our finest Justices to serve on the Supreme Court. He needs to be remembered. He is what makes our nation great.

The argument is that any direct payout or subsidy to an individual creates a dependency and de incentivizes work and furthering education. However the other three “subsidies,” bailouts and insurance for crops benefits everyone and keeps the economy going. It’s like a ladder or a highway. A tool.
