Our brief argues what Plaintiffs have already proved: inter-district racial segregation exists across New Jersey, that these conditions are unconstitutional, pervasive, and interconnected, and that the state has the power to create an integrated school system.
Decades after Brown, New Jersey schools have remained deeply segregated, resulting from statewide policy choices. In 2023, a trial court demanded proof of segregation in every single district as a prerequisite for court intervention, but that's not how constitutional enforcement works.
We’re beyond proud to stand with the ACLU of New Jersey and the Racial Equity in Education Law & Policy Clinic (REEL Policy Clinic) at Georgetown Law in filing an amicus brief in Latino Action Network v. State of New Jersey.

Why? Segregated schools often have fewer resources, harsher discipline, and less experienced teachers.
The silver lining? Poverty doesn’t predestinate students to academic failure. We can integrate and equitably fund schools!
Student A: Grows up in poverty, but attends typical schools ➡️only about 6% less likely to graduate on time
Student B: Grows up in poverty AND attends schools with concentrated poverty ➡️ 30 percentage points less likely to graduate on time.
