Presidents have the right to express themselves before the FCC. Unlike a cabinet secretary, however, the chairman of the agency does not report to the president. The FCC is chartered by Congress as an independent agency, separate from the executive. It bodes poorly for future media consolidation.

I realize that but it was public pressure from the sustained outcry over the entire matter that caused CBS to settle. The merger was an undue influence over their decision. It avoided a protracted and expensive court battle.
