SCOTUS has frequently ruled that gerrymandering for political purposes is allowed. But when you disenfranchise PoCs while doing it, you run afoul of 14A. The GOP is excellent in masking their deep rooted racism (Lee Atwater: "you can't say n*, n* anymore")so it's hard to prove it in court
