I am not inclined to sympathy towards rich straight assholes, but the ‘you deprived this sympathetic straight person of the heterosexual stability they deserve’ is the exact line that the rape by sex deception laws take. It’s the line that puts trans people in jail for not disclosing.

Also, this line of inquiry would seek to protect someone whose husband has a secret family, but not someone who leaves as soon as the baby is born because he just wanted someone to have his kid. There’s not much pragmatic difference there, except that one is a greater violation of heteromonogamy

The rubric of ‘obtaining someone’s consent by’ is absolutely insane if you think about it for 5 seconds. It assumes childlike passivity. People consent to sex in the knowledge that they cannot have full information about their partner.

Stealthing is a form of immediate violation where the consented-to activity is altered. It is illegal. Infidelity is not illegal and shouldn’t be illegal. Even if it’s a really, really bad and sympathetic case of infidelity, it’s not rape.

I am going to lose my mind. As someone currently doing legal research into sex deception laws, I don’t trust rape law as far as I could throw it, but this is not a CURIOUS FEATURE OF THE LAW
