Miller will leapfrog CA9 and get on the emergency docket tomorrow. Roberts will get him an unsigned admin stay by end of week and then slow-walk it as long as possible b/c he hopes to moot it before being forced to approach merits.

Absolutely naive to think Roberts and his 5 cronies give even a single damn about what the lower courts think. They view their orders as sacrosanct and all other courts in the country as meaningless trifles.

The problem is SCOTUS won't even engage with the merits. Roberts' MO is to issue an unsigned admin stay and then stall as long as conceivable to moot it before having to provide an iota of reasoning. Miller will leapfrog CA9 to the emergency docket tomorrow and Roberts will acquiesce again.

I think the most likely outcome is that Miller will leapfrog CA9 and go straight to an emergency petition at SCOTUS tomorrow morning. We'll likely see an unsigned administrative stay by end of week. B/c Roberts wants to avoid Trump violating court orders without giving a merits opinion at all costs.
