He was at the center of the Justice Department turbulence after Mr. Trump invoked the 1798 Alien Enemies Act to deport illegal aliens without due process. At a March 14 meeting, discussing the possibility that a judge could block those removals, โ€œBove stated that DOJ would need to consider telling the courts โ€˜fโ€” youโ€™ and ignore any such court order.โ€ Thatโ€™s according to a โ€œwhistleblowerโ€ letter by a former government lawyer.

Testifying to the Senate, Mr. Bove didnโ€™t exactly deny uttering such a thing. โ€œI did not suggest,โ€ he said, โ€œthat there would be any need to consider ignoring court orders. At the point in that meeting, there were no court orders to discuss.โ€ What about floating that the Justice Department might tell the judiciary to eff off? โ€œI donโ€™t recall,โ€ Mr. Bove said. Doesnโ€™t this seem like something a top official would remember saying, or not?

The whistleblower then released communications to back up his account. One is a text message from March 15, as Mr. Trumpโ€™s deportation flights to El Salvador were about to land. โ€œGuess its find out time on the โ€˜fโ€” you,โ€™โ€ the lawyer wrote his supervisor. The bossโ€™s reply: โ€œYup. It was good working with you.โ€

The Judiciary Committeeโ€™s GOP majority dismissed this evidence as โ€œcompletely devoid of context.โ€ That sounds like an argument by plausible deniability. The whistleblower made specific claims, and isnโ€™t his account context?

The conservative WSJ edit page comes as close as it comfortably can to telling the Senate that Emil Bove is utterly unqualified to be an appellate judge.
