Under Bivens, there is limited ability to sue ICE agents for unlawful uses of force and illegal searches. This makes the deal @durbin.senate.gov just cut that allows Senators to sue over far less all the more disgraceful.

Figures they’d decide to protect their own privacy and no one else’s. Were it any more direct it would be a 27th amendment violation :P

I don’t teach a first amendment course, but I would be curious to see parts of the book!

I have real federalism concerns about a state trying to create a vehicle for suing federal agents, but that's a bit outside my area.

In addition to the arrest, ICE also apparently conducted a non consensual search of private property without the benefit of a search warrant.
We need a federal statutory Bivens remedy. As it stands, I’m not sure what can even be done if ICE simply ignores the Fourth Amendment.
