Judge: That's what I'll do. Prohibit federalization or deployment of any NG troops into Oregon. For all reasons in prior opinion. Deployment of federalized military is ultra vires and contrary to law, violating Title 10, section 12406. I also find it's likely that defendants violate 10th Amendment.

This reminds me of when we had a gaggle of neo-nazis walk thru one of our nightlife districts and when the cops later pulled over the u-Haul van they were packed into, one of the officers said something like “I mean I appreciate your 1st amendment rights and stuff but man like the game is on.”

I'm trying (failing) not to do punditry on this stuff, but I genuinely don't understand this argument that shutdowns "hand the keys" to the executive branch. You can only say that if you bake in the idea that the exec branch will lawless things during the shutdown. If that's right, seems bad!
