The criteria for uplift are clear in paras 12.8 and 12.9 of the Costs Assessment guidance. I used a proforma matrix for pleading uplift and it was rarely refused. Hours worked were never an issue. I kept immaculate attendance notes.

Civil legal aid on housing law certificated cases is paid at £59.40 ph. Max uplift claimable is 50 percent, hence £89.10 ph. The figures are insane. Thank god there are dedicated lawyers in housing law who are willing to earn these pathetic rates. A luta continua.

Luckily there are good Counsel who specialise in housing law and who are (perhaps reluctantly) willing to accept the Legal Aid rate of £89.10 ph, if 50 per cent uplift is claimed. But the fees become very commercial if an inter partes costs order is obtained ...
