Arguably, this validates the tendency in the literature to approach the issue as state preferences rather than government preferences.

Governments of newer MS that are net recipients of funds tend to be more hesitant about enforcing the RoL.

ECA's report on enforcing EU law is now available. It notes Commission's preference for a dialogue-based approach to non-compliance, the need for enhancing the management of the infringement procedures and recommends sanctions with a stronger deterrent effect.
