Right now, under federal statutes, President Trump can call us up as the militia if he sees it necessary, especially for three purposes: to repel invasions, to suppress insurrections, and to execute the laws of the union. And right now, we see all three of those in play. ... And the militia is all of us. So the National Guard is part of the militia, which is why it's completely lawful for him to use the National Guard as he has, and he should do more of that, I think, across the country. ... He could just say given the circumstances of an invasion, insurrection, and resistance against federal law being being enforced, I'm calling up the militia, ordering all the men to come together [in] every county, put the veterans in charge of training and organizing all the other men and just have them stand too and await his orders. He can do that and I think he should do that. And so that's what I'll be advocating for from him. So from the bottom, from down the rank and file, we can let President Trump know that we're ready to serve, encourage him to do that, call us up as a militia, order us all to come together in our counties under his command, which gives you complete legal sanction to do what you're doing.

But the district court did not order the government to use the Section 32 fund until November 6. It did so after it concluded that the government had failed to comply with its October 31 TRO. As a remedy for that noncompliance, the court ordered the government to make the full payment of November SNAP benefits by November 7. Thus, even if we were to stay the second TRO, the government could not obtain the relief that it seeks unless it also meets its burden under the stay factors as to the enforcement order. For the reasons that follow, we conclude that the government has failed to meet the stay factors as to the enforcement order, and we deny a stay of that order.

In any event, the district court has now found that the government failed to comply with that October 31 TRO, from which no stay was sought and no appeal was taken that would have prevented the order from taking effect during the period of alleged noncompliance. Thus, for present purposes, the question that the government's motion to stay the enforcement order presents is this: Has the government made a strong showing that it is likely to succeed in establishing either (a) that the district court erred in finding noncompliance with the October 31 TRO or (b) that, insofar as it did not err in that regard, it could not order full funding in consequence of that noncompliance? As we have explained, the answer is no. In the single paragraph it devotes in its stay motion to addressing the enforcement order, the government does not make a strong showing of likely success in either respect. And in the only other passage of the stay motion that could be read to address the finding of noncompliance, the government fails to grapple with the actual basis for that finding.

Mamdani and Mikie Sherrill, who won the governor’s race in New Jersey, were even more affirming in their support for trans rights. All three major candidates were laser-focused on affordability, telling voters in detailed ways how Trump has harmed them, and how they would build a broader society together rather than trying to tear it apart.

Despite having different ideologies, all three major candidates—Abigail Spanberger, Mikie Sherrill, and Zohran Mamdani—were laser-focused on how Donald Trump has damaged Americans' lives and how they'd fix things.

And all 3 also rejected establishment Democrats' advice to abandon trans people.

Today is an absolute rebuke of anti-transgender politics, and a real sign that the anti-trans panic is fading.

A group of faculty unions at the University of Alaska are petitioning the UA Board of Regents not to sign on to President Donald Trump’s “Compact for Excellence in Higher Education.”

And again, a pattern of putting out statements accusing people of serious Federal crimes and then releasing them hours or days or weeks later with no charges. And no retraction.

Dayanne Figueroa was on her way to get coffee before heading to work when she encountered a chaotic scene in West Town: heavily armed, masked federal agents making arrests on a residential street. People yelled as vehicles honked their horn — a sign now used to alert neighbors that immigration federal agents are in the area — and witnesses said federal agents had arrested several landscaper workers presumed to be in the country without authorization. As Figuero tried to drive through the 1600 block of West Hubbard Street on Friday, Oct. 10, an unmarked vehicle driven by federal agents collided with Figueroa’s as it tried to speed away from a hostile crowd, multiple videos reviewed by the Tribune show. Seconds after the crash, agents abruptly stopped their vehicle and exited with weapons in hand pointing at Figueroa, a U.S citizen. Agents then forcibly opened her door and pulled her out of the vehicle by her legs without identifying themselves, presenting a warrant or informing her that she was under arrest. As bystanders yelled, “You hit her! We have it on video!” agents ignored the crowd and forced Figueroa into a red minivan and drove away. Her car was left behind in the middle of the road, her coffee still in the cup holder, and her keys in plain view. The Department of Homeland Security later released a statement claiming that Figueroa was at fault, saying “she crashed into an unmarked government vehicle and violently resisted arrest, injuring two officers.”
