At the very least, this article should refer to the office of the Presidency and not Trump the person as the entity that is delegated the authority. Nonetheless, thank you for this work.

This is in total contravention of the notions of due process and individual liberty. Don't use people as pawns.

So look at that. DOGE has cost the US Treasury fucking half a trillion dollars. HALF A TRILLION DOLLARS. This is your cost savings.

As far as I can tell, states secrets wasn't even on the radar until the Court brought it up during Monday's hearing. And that was almost in passing as the Court was describing the basic procedures for how to handle confidential information to the government lawyers.

What plausible basis is there to invoke the states secret doctrine? I really have a hard time seeing this as anything other than an out for the government.

Many of them were tentative from the start. If they wanted the thing to go down, they would have been loud on it. They could have forced Schumer's hand. They weren't ready to own this.

The Senators who voted no were given cover by Schumer to do so -- a lot of them actually wanted the thing to pass and didn't want the fight and only flipped to "no" when the pressure campaigns flooded their phones.

There's a long history of counter-party maverick pols like yourself not working out and getting booted out of office. And the last one to really do it successfully spent over 5 years in Hanoi for his country.

If anything, you bashing your own party is performative. It is possible to explain your vote without taking gratuitous potshots at your own party.

Wasn't the NEA amended after Chadha so that Congress is required to pass a joint resolution, likely with a 2/3rds majority to overcome a Presidential veto, in order to suspend a declaration of a national emergency under the NEA?

Seems pretty clear to me. When you complain about judges, you are putting them personally at risk and are undermining the rule of law. When they complain about judges, they are defending the rule of law.

There is no legal authority to deport or otherwise send incarcerated US citizens to another country. And not even the courts would go along with this.

It's deeply irresponsible that Rubio -- who knows better! -- even put that offer out there into the public sphere. It's not a real possibility but Trump will surely be chomping at the bit to take up Bukele's offer.

Don't talk about how Trump is usurping Congress's power of the purse -- people will say, good, Congress sucks at that

This $, like the $ for Headstart, Meals on Wheels, WIC, or even Social Security,Medicaid,Medicare, is there to help people and to make the world more secure, to stop wars. Trump/Musk want to keep all of it for themselves and spend it on tax bailouts and handouts to cronies and big corps

Thank you for your reporting on this. It seems like a lot of this is going under the radar, with significantly less coverage than other big issues even though it will directly lead to many people dying. I know folks in the foreign aid industry and it seems like maximum confusion right now.

Is academic scholarship such a house of cards that it collapses when a law professor gets criticized for a pretty obviously terrible take?
