It’s a super small thing and not at all the point but both Jackson and Sotomayor capitalize Black. The majority opinion and Thomas don’t unless in a quotation. Gorsuch defaults to African American unless citing. And Kavanaugh doesn’t use the word Black once. Those are red flags for me personally.

A - this sucks

B - This is why Natives beat people over the head with "Tribal membership is a political identity. Not a racial one."

Absolutely agreed.

By default, this will be the Bad Place for marginalized people because structures of oppression operate through folks without their consent. This is one of the reasons why, despite the overwhelming queer and trans population here, BlueSky remains a very white space.
