That question was not before the court, so they couldn't rule on that. As the case continues to work its way through the lower courts, that will likely be brought up. At that point, when the Regime inevitably appeals their loss to the Supreme Court, that could very well be part of it.

They didn't hear arguments on the base legality. All they did was hear an appeal to the TRO. The actual full case itself has not been heard by the Supreme Court as the case is not done in the lower courts yet.
