Neither of these reasons is likely to convince the Court: First, with respect to the rationale that "cordon pricing" is not authorized under the phrase "congestion pricing" or "value pricing," we have been unable to identify a compelling legal argument to support this position. As you are aware, the legislation that enacted the VPPP, Section 1012(b) of the Intermodal Surface Transportation Efficiency Act (ISTEA), Pub. L. 102-240 (1991) (23 U.S.C. § 149 note), as amended by Section 1216(a) of the Transportation Equity Act for the 21s Century (TEA-21), Pub.
