This is the line from the horrific SCOTUS decision today that will stick with me. “Sure, the president should follow the law - but the courts can’t force him to do it.” Rendering the Constitution a dead letter if the president decides he’d rather not deal with it.

Although Alito frames the remedy here as "notice and opt-out," the reality is that school districts cannot manage such a sweeping opt-out system. They are far more likely to simply pull books with LGBTQ characters off classroom shelves altogether rather than face a ruinous, high-profile lawsuit.

Bonus 136: Nationwide Injunctions vs. Nationwide Class Actions If those who oppose non-plaintiff-specific relief are doing so on principle and not just politics, they should support more robust nationwide class action suits against the federal government.

It's worth keeping in mind, insofar as today's #SCOTUS ruling is going to put a lot of pressure on federal district courts to certify nationwide class actions, that part of why nationwide classes have become harder to certify is because of ... the Supreme Court:

Nation-wide injunctions do not give the courts unfettered power. It’s giving them the power to hit pause while cases work through the judicial system. It seems to prevent irreversible harm like people being sent to foreign prisons with no way of getting them back. Am I wrong?
