By my count, 44 states still have these laws in effect. Since 2019, Illinois, New York, Maine, and now Missouri have set the good example of repealing their pay-to-stay laws.

Missouri’s Incarceration Reimbursement Act Repealed - Missouri Appleseed On March 12, 2025, Missouri House Bill 495 was truly agreed to and passed with language that repealed MIRA.

Tardy to the party, but thrilled that Missouri has repealed its pay-to-stay law! In addition to being unjust and creating a hurdle to people's reentries after incarceration, these laws are ineffective. The costs of administration outweigh the fees collected.
