The Ninth Circuit just paused the three-judge panel’s order on our first TRO until Tuesday so they can complete their en banc vote, deciding whether the full court will hear the case.
 
This means for now, both our TROs preventing National Guard deployment remain in effect.

Today’s Ninth Circuit’s administrative stay will last until 5pm on Tuesday 10/28. This will maintain the status quo—preventing deployment of National Guard troops in Oregon—while the court votes whether to rehear the case en banc. Given this development, we expect the second TRO will remain in place as well.
 
Our team is working around the clock preparing for the trial in the district court on the merits of this case. The trial will begin on Wednesday 10/29.

Meanwhile, we will be filing a brief in the Ninth Circuit later today urging the court to hold an en banc hearing on the motion to stay our first TRO. 

This means that, for now, National Guard troops still cannot be deployed in Oregon.

What happened: The so-called Defund Provision of the Big Beautiful Bill Act blocks federal Medicaid funding for essential medical services like cancer screenings, birth control, STI testing, and wellness exams provided at “prohibited entities.” The criteria for a “prohibited entity” were crafted so it applies almost exclusively to Planned Parenthood. The provision threatens at least 200 Planned Parenthood health centers nationwide, affecting healthcare for more than 1.1 million people.

Oregon and a coalition of 23 states sued in July, and the case is currently pending. Planned Parenthood filed a parallel challenge, and Oregon and other states have filed an amicus brief in support.
