Perhaps only #StarTrek fans will understand this, but for the past two weeks I often have felt like I am witnessing something from the Mirror Universe.

I just encountered a voice based, automated customer service system that supposedly uses a form of AI, but in truth is an Artificial Stupidity System (ASS) that serves only to delay and obstruct customers from obtaining assistance. A good way to frustrate customers. Worse than bad “hold” music.

You are correct, there is no end to the unprincipled, result-oriented legal positions being asserted by people who are more interested in political outcomes than in law. I have called this out both on the right and on the left over the years.

That is the easy case.

That is certainly true in a preliminary injunction context, where likelihood of success on the merits is a key consideration. There also is a structural issue-do trial judges, sitting individually, properly adopt new legal theories, or should that be the role of appellate courts? No “rule” on this.

I can see that in certain circumstances. But it is hard to generalize. How does a judge decide that a legal position is “bad,“ and are there degrees of “badness?“ There are specious new theories supported only by literature, but there also have been some good ideas.

However, with our luck, we would probably get the Kanamits from #ToServeMan

I agree with these reactions, I am sorry to say.

I have watched the first 25 minutes of “Section 31,” the new “Star Trek” movie streaming on Paramount+. It is an understatement to say I am so disappointed. Worst Star Trek movie I have seen. The only one I have disliked. It is a disservice to the franchise. A ridiculous mess. What am I missing?

I often have thought about “Invasion of the Body Snatchers” as symbolic of recent events.

I have seen situations where emergency orders by a single judge granting or denying provisional relief have been reversed by a panel. But this is the first time I have seen a provisional order by a motions panel reversed by a merits panel before full consideration of merits. #appellatesky
