The ICC investigation in Afghanistan was resumed in late 2022 upon the Prosecutor's request after the #Taliban 's takeover of the country.

This investigation is framed broadly enough to include within its scope the alleged crimes mentioned in the collective state referral without the Prosecutor

On 28 November, six states— #Chile , Costa Rica, Spain, France, Luxembourg and #Mexico —referred the situation in #Afghanistan to the ICC Prosecutor, pointing out that the grave violations of the rights of Afghan women and girls by the Taliban may amount to crimes under the Statute.

Por cierto, todo esto en el mismo día en el que el gobierno de España ha anunciado una contribución especial de 1,6 millones de euros para la Corte y que cumplirán con las órdenes de arresto dictadas si se da la ocasión.

3.🇦🇫No hay que olvidar que hace unos meses una serie de Estados anunciaron que tenían la intención de llevar a Afganistán ante la Corte Internacional de Justicia por violaciones de la Convención sobre la Eliminación de la Discriminación contra las Mujeres.

2.🇦🇫 Desde el 2020 ya hay una investigación abierta en la Corte Penal Internacional por la situación en Afganistán desde el 2003, por lo que está remisión probablemente no implicará la apertura de una nueva investigación.

I would say it’s a matter of domestic law. States have the obligation to comply with the arrest warrant, how they do it just depends on the legal system of each state.

5. Por ello, la Corte Penal Internacional ha emitido hoy órdenes de arresto relacionadas con crímenes cometidos en territorio palestino (por Netanyahu, Hamas, y Deif), pero también por crímenes cometidos en Israel por ciudadanos palestinos.

4. Palestina es un Estado parte del Estatuto de Roma desde hace casi una década. Por ello, la Corte Penal Internacional tiene jurisdicción sobre los crímenes cometidos en Palestina y los crímenes cometidos por ciudadanos palestinos.

Supongo os preguntaréis por qué no estamos hablando de genocidio, y la respuesta corta es que es un crimen extremadamente complejo de probar.
Sin embargo, esto es lo que decía TPIY sobre el crimen de lesa humanidad de persecución (Prosecutor v. Kupreski et al Trial Judgment.

5. Por cierto, el contenido de las órdenes de arresto es confidencial de momento. Criticar las órdenes "porque no hay pruebas" como ya he visto es completamente absurdo.
Los únicos que han visto las pruebas son la Fiscalía y la Cámara.
