It’s true that any Federal Judge COULD swear in Adelita Grijalva if the Speaker Johnson refuses to do so. That said, the House decides who is seated as a member. If a federal judge were to swear in Grijalva, the House could, and likely would, challenge her seating.

It does, though, because reaching the 218 threshold means that it MUST go to the floor for a vote. As soon as she is sworn in, she can sign on to the petition and there are “no backsies”. The only way he could prevent it coming to the floor would be to shut down the House indefinitely.
