I think she's using (perhaps whether she knows it or not) the Terry v. Ohio (1968) Supreme Court ruling for reasonable suspicion which they decided on the *basis* of probable cause from the 4th Amendment. However, racial profiling is a violation, and they would need to prove they had another cause.

Personally I don't see that much harm in saying good bye to a species. It's a little sad, but I think what we're mourning are the individuals, and that's the difference to me - it's a taxonomic classification vs. individuals, and the individuals are the ones who suffer via exploitation and killing.
