If it were GDPR based reasoning, it would be a stricter test. Not just equivalence and effectiveness but full proportionality. In this one case, the rationales might work, because the requests might be absusive. But when there are no indications of abuse, I find it difficult to see the necessity

The fake names are not. But the real names the authority wants to process are. And thus their processing must be necessary (and there the environmental law might come into play).

So I am surprised it is all about what an "applicant" is and not also about Art. 6(1)(c) or (e) GDPR.

What I find really surprising about this case: it is, in essence, about whether member states may process certain kinds of personal data. And yet nobody seems to have made it a data protection case.

The EU has just published the final version of the Article 122 Regulation that, as of today, indefinitely immobilises the Russian assets.

It sets three key conditions to release the €210 billion:
1) Russia ends the war
2) Russia pays reparations to Ukraine
3) Russia is no longer an economic threat

The word ‘applicant’ in Article 2(5) of Directive 2003/4, read in the light of Articles 2 and 4 of the Aarhus Convention, must be interpreted as meaning that it is not limited to a natural or legal person identified by that person’s actual name and/or a current physical address but also includes an anonymous or pseudonymous person and/or an applicant whose contact details are identified by email only.

Last year the German Federal Administrative Court ruled that anonymous applications under the Freedom of Information Act are inadmissible. Jannis Krüßmann and I wrote a (German) blog post on how the court's reasoning does not hold for environmental information.

Zumindest das UIG hat zum Glück eine Grundlage im Europarecht. Damit gibt es einen Mindeststandard, hinter den der Bundesgesetzgeber nicht zurückfallen kann (nicht einmal durch Aufhebung des Gesetzes).
