Patel doesn't know or is more likely lying. It's not just the 5th Amendment, either, it's the 14th amendment applying to state level due process. Plus, there are Supreme Court decisions reiterating that *everyone* inside the US, here illegally or not, get due process rights. Shaughnessy vs US etc.
