To put it another way, I will agree to the "is" being changed, but not the "ought."

Not that it would (or should) matter for the civil case, but the irony in this argument is that halakhah only applies the commandment to "be fruitful and multiply" to men, not women.

I agree that performance has changed over time, but I cannot view halakhah as anything other than normative considering it's literally a collection of norms. To put it another way, I wouldn't consider legitimate variants of observance w/in the norms to be a halakhic "change."

The claim that halakhah "changes" presumes a definition of halakhah, or more precisely, a narrative of defining halakhic legitimacy.

In fairness, I'd say most claims to authority are either tautological or based on faith in a first principle.

Only though tautological definitions of authority and legitimacy.
