We discussed that in class. I don't think they are precedential but the Court treated Wilcox that way in Boyle, so it seems unlikely to me that any lower court would hold otherwise until Slaughter comes out. Making law that way is problematic, as Vladeck and others have observed. But here we are.

This is what it's come to. DOE illegally cancels projects and GOP Senators say it's OK because they can go hat in hand to beg to keep the ones in their states going. Not how Congress works, folks.
