We sent two pre-action letters, challenging the lack of a #CommunityCare assessment and failure to meet our client’s care needs.
 
We also argued it was irrational to state our client and his mum were refusing to provide evidence when they didn’t have the evidence to put forward.

The local authority refused to assist due to lack of evidence they’d been residing in the area – but this was due to them having no entitlement to public funds, no rent agreement or bills in their name.
 
The only info they could provide were prescriptions showing the address.

He wouldn’t eat, drink or take medication because he believed someone was trying to poison him. 

We argued that he had care needs and required accommodation under the Care Act. 
 
We also argued that Adult Social Care should house his mum because she was the only person he trusted.

A two-day fact-finding hearing was held, involving cross-examination of the young person and the local authority's social workers. This was an extremely stressful experience for our client who was already dealing with a traumatic history.

The Tribunal accepted his claimed age (18 at the date of the final hearing) and ordered the local authority to pay his legal costs. He will now be entitled to care leaver services as a former looked after child.

He arrived in the UK as a 15 year old, claimed asylum and was taken into foster care. But the local authority later disputed his age and assessed him to be an adult, withdrawing children's services, and sending him to Home Office adult accommodation. Following a judicial review claim, the High Court granted interim relief and ordered the local authority to treat the young person as a child pending a fact-finding hearing in the Upper Tribunal.

Freedom from Torture provided charity accommodation on eviction day, and the next morning we submitted an urgent application for interim relief. Lawstop: No 1 UK's Largest Legal Aid Provider of Housing Legal Aid

After no response to our pre-action letter, @freedomfromtorture.bsky.social  provided charity accommodation on eviction day and we issued urgent proceedings the next morning.

Within four hours we received a Court Order ordering the Local Authority to provide suitable accommodation.

Public law case won. We urgently challenged a Local Authority to prevent street homelessness for a vulnerable refugee with PTSD.

He's a survivor of torture with PTSD and was facing street homelessness after eviction with no interim support from the Local Authority.

Ending #RefugeeWeek as we started, sharing another impactful partnership: with Heart4Refugees, in the Wirral.

We've been leading 'Introduction to Housing Law' training sessions to frontline staff since November, giving them the knowledge to offer housing advice and referrals for their community.

Often the Refugee Roots team encounters difficulties with sourcing legal aid, immigration advice and support on the issues facing participants.

So we're proud to bridge this gap and support the charity to offer free legal advice to refugees and asylum seekers in a weekly legal clinic.

This #RefugeeWeek, we're excited to announce our new partnership with Refugee Roots, offering a weekly legal clinic for participants.

The charity provides befriending, support and empowerment initiatives to refugees with advice and guidance on welfare, housing, and employment.
