Trump's Birthright citizenship executive order blocked nationwide by Judge Sorokin and separately 9th circuit - and judge LePlante takes out injunction for emergency class of babies affected by order Short summary: This means nothing happens on July 27th, the first date for the government to try to put the birthright citizenship executive order in place.

So the likely interpretation is that the Supreme Court chose this case in order to put the whole question to rest as quickly and decisively as possible. That is from Volokh Conspiracy which is very respected / authoritative.

Although the language is the same, for originalists the meaning was clearer at the time it was put into law and since then it's always been interpreted the same way. That makes the Supreme Court's task much simpler and easier to achieve a 9 : 0 decision against the government.

So the Supreme Court chose a case that makes it easy for them to focus on the easier question of the interpretation of 8 U.S.C. 1401(a) which lets them sidestep the question of whether the U.S. Constitution permits Congress to pass legislation to interpret 14th Amendment Section 1 differently.

But wait, some may argue, doesn't the statute merely repeat the language of the Fourteenth Amendment? ... Yes it is the same language, but the public meaning of the statute, when enacted, need not have been the same as the public meaning of the earlier-adopted constitutional provision. ... that interpretation would be entitled to statutory stare decisis ... even if one were to believe ... that Congress has the power to narrow the scope of birthright citizenship through legislation. ... What this means is that the Court could simply hold that the Executive Order conflicts with the longstanding interpretation of 8 U.S.C. 1401(a) and defer to another day whether Congress could enact legislation adopting a narrower rule.
