Bio suggests she would be 70 in 2031, which is when her term ends anyway. The trend has been to retire about a year before the election to let the governor appoint the next "incumbent." Given that we have had our last two redistricting maps drawn by a panel headed by the Chief Justice...

JAGs are getting assigned as Special AUSAs, and one got held in civil contempt in Minnesota this week. Are these assignments literally just so they can't resign like many of the D.Minn. attorneys have done? Do they have any recourse if they don't want the assignment?

I wonder if, to the extent there are federal criminal proceedings here, every defense attorney in D. Minn. is demanding a speedy trial...

I think Jensen is running on the GOP side now too instead of running for governor? The wrong auditor can do great damage; the right one often goes unnoticed (though Blaha did assist with an investigation that resulted in a federal conviction for our now-former township clerk).

If she wins. Her comms have been so tone-deaf I'm not sure, depending on her eventual opponent.

A data table with three columns labeled "(index)," "Type," and "Count." The index column has values increasing sequentially from 0 to 26. The "Type" column starts with 'Immigration - Habeas Corpus - Alien Detainee (Prisoner Pet...', and the corresponding "Count" is 565. Next is 'Personal Injury - Health Care/Pharmaceutical Product Liabi...', with a count of 40. The results are sorted in descending order by Count.

I could have made an error, of course. Here is the summary I got in the browser console. /end

MND New Cases Report

Excellent article, and you'd know better than me which cases should count, but looking at the New Cases Report (ecf.mnd.uscourts.gov/newcases/ope...) and doing a bit of scripting, I see 565 immigration-related habeas petitions filed in January 2026. Another 30 are "Habeas Corpus - General." /1

Isn't D. Minn. down about 14 attorneys and counting, just from resignations in 2026?

Talking with Hennepin County Attorney Mary Moriarty about Trump, Operation Metro Surge β€” and FAFO Watch now (47 mins) | "[T]he people of Minneapolis are looking around, and this is what they’re saying to their electeds too, is, β€˜Who is here protecting us?’”

If you missed it, be sure to check out my in-depth discussion with Hennepin County Attorney Mary Moriarty β€” who talks about Trump, Operation Metro Surge, Walz, local police, local prosecutors starting FAFO (Fight Against Federal Overreach) to push back, and more.

Also, Dems have a decent shot at House seats. IA01 barely went red the last two elections (literally six votes in 2022 IIRC). They could realistically flip up to three of the four seats.

Governor is likely competitive. Rob Sand is the only Dem holding statewide office there currently, and he is running for Governor.

Read the whole order. It's a stick to get the petitioner released before Friday, in which case the judge will cancel the hearing (upon joint stipulation that the petitioner is released).

We'd get an appointment to Klobuchar's seat first if she won, though, right? I don't know when we would have to vote to keep that Senator; I thought we had Tina Smith on the ballot the next November after her appointment, but I don't recall all the details.

If 2029 rolls around and these prosecutions haven't yet commenced, and there are favorable officeholders then, I would expect an attempt at prosecution. After that... I have my doubts. /end

Competence of the next Hennepin County Attorney could matter. Mary Moriarty is not running for re-election, and realistically, any prosecution is likely to take enough time that the next County Attorney would at least be involved. /3

A bigger risk is electoral. I anticipate a lot of money backing a GOP candidate for AG who won't pursue the prosecution. Hennepin County Attorney is also a risk but maybe less so; it's officially nonpartisan, and no R is likely to win there... /2

Not a lawyer, but a Minnesotan here... Knowing the relevant MN officials right now (particularly Keith Ellison), they won't give up on this. If there are prosecutions to make, they will find a way to make them. But... /1

Defendants are aware of their obligations not to destroy evidence. As the declarations make clear, Defendants are complying with those obligations. The relevant government entities are entitled to the presumption "that they will act properly and according to law." FTC v. Schreiber, 381 U.S. 279, 296 (1965). While such a presumption may be overcome, the presumption must be rebutted with something more than the baseless speculation Plaintiffs assert here. See McDonough, 799 F.3d at 948.

While folks are opining on this morning's hearing in MN v. Noem, let's not forget the hearing this afternoon in BCA v. Noem, featuring this paragraph from the reply in opposition that I'm sure everyone is going to believe. www.courtlistener.com/docket/72185...
