Also since this is a Habitat building - if it has federal funds, anything above 4 stories triggers additional requirements like higher wage standards. HUD is working on increasing that to 7 stories but hasnโt yet.

4 story buildings usually arenโt required by code to have elevators but most developers add elevators at 4. And yes over 5 stories there would be at least 1 level of concrete. Over 7 it would be all concrete or steel.

If the landlord canโt contractually commit to providing the space or its quality, then the tenant is going to act* as if that space doesnโt exist. They will value the space roughly the same as a building without outdoor dining.
*Assuming they are rational, well-informed actors.

Commercial leases are brokered and highly negotiated.
If a landlord owns a shopping center and provides a patio adjacent to a restaurant, they might formally include the patio and charge half rent for it. A landlord can try the same with public parking spaces but they arenโt likely to succeed.

The landlord can only really price it in if the outdoor space is committed for the term of the lease. If itโs just a temporary program offered by the municipality, the landlord is only likely to benefit insofar as it makes their tenant more profitable and therefore more likely to pay the rent.
