Like yes copyright is stupid but IA didn't have a hope in hell of winning that fight because it KNEW it was breaking copyright law and did so flagrantly which is not a winning legal move. Imagine if the court costs IA spent on that instead went into preservation efforts

They already had the right to loan books for free and there was very little advantage to offering multiple simultaneous loans for the vast majority of books and they lost 500k books permanently by fucking around and finding out.
