I understand the point of view that, while there is a delay, the fear is that gender critics will continue their law fare and get exclusionary policies embedded. However, I think it’s really important to understand that the Code can only be *published* once it is approved by the Minister for Equalities and laid in Parliament. It will then become statutory after 40 days, *automatically*. Because the Code will be laid under the “negative procedure“, there will be no opportunity for MPs to debate, vote on or change the Code. MPs can try to table a motion calling for a debate and vote. However, it’s up to the Minister to allow time for this, and she will likely refuse given that by that point, she will have formally approved the code. MPs can try to table a fatal motion against the Code to get it annulled, but such a motion has not succeeded since 1979.😧 So once the Code is published, there is almost nothing we can do. We would have to go to court to get the entire approved Statutory Code of Practice overturned. This is a massive uphill battle. In the meantime, gender critics will use the Statutory Code, and it’s exclusionary policies, to secure more legal wins. What we can do instead *right now*, is pressure Phillipson to *reject the draft Code* and instead send it back to the EHRC, with a demand that it be rewritten to include guidance on how trans people can be lawfully included in single-sex services according to their lived gender.

See here: https://actionnetwork.org/letters/scrap-the-bathroom-ban With the addition of the complaints from Labour backbenchers on the cost of businesses, and the recent statement of alarm from the Human Rights Commissioner of the Council of Europe, the messaging is really cutting through that this Code of Practice is absolutely unfit for purpose and needs to be written, not approved. By delaying the Code, Phillipson is also allowing a number of things to happen — the outcome of the Good Law Project judicial review on 12th November, which may itself deem the EHRC position of mandatory exclusion unlawful — running down the clock on Kishwer Falkner’s term as EHRC chair, such that once she is gone, we can go back to the drawing board and work on getting this code re-written, not approved.

There are clear signs that Phillipson is not happy with the EHRC or the Code that they have produced. Her own submission to the judicial review diverges wildly from the EHRC position, and proffers legal arguments of how trans inclusion can still be lawful, and how mandatory exclusion may be discriminatory. https://drive.google.com/file/d/1iN4GscMz-4k9oRHVFZfJxrQhXNaa1tFL/view Asking Phillipson to publish the Code right now will do nothing but play into the hands of the gender critics and lock in devastating policies of trans exclusion. Please join us instead in pressuring Phillipson to reject this draft Code and get it re-written to ensure trans inclusion. This could save us a huge amount of pain and work down the line 🙏🙏🙏

We are already helping several employees sue employers for enforcing the EHRC Interim Guidance, which *we think* is unlawful. Should the High Court agree, we plan to make available in generic form, for free, and in a usable state, all the legal materials a trans employee needs to sue their employer.
