The proposals to limit Article 3 are absolutely terrifying. I struggle to think of something that has come out of any UK government which has concerned me more. This must be resisted absolutely.

Dear GOD if you want to save money in the asylum system
1. LET ASYLUM SEEKERS WORK
2. FAST TRACK STATUS FOR EVERYONE FROM CLEARLY UNDAFE COUNTRIES like Sudan, Syria, etc
3. Run an asylum accommodation system that is NOT FOR PROFIT #r4today
guy said, โDo you like Marx?โ I said, โI havenโt met him.โ Guy said, โNo, no, heโs dead.โ โWow, what happened?โ โNo, no, he died long ago.โ I thought the guy Marx had just died. So then, โWhy are you asking me if he died long ago?โ โNo, he wrote a lot. He wrote that poor people should not be poor.โ I said, โSounds amazing.โ Iโm giving you a sense of how naรฏve I was. After they left, I went to the library to look for Marx. So that was my introduction to Karl Marx. BS: The FBI. MM: The FBI. Then, of course, I took a class on Marx. Don't roll out the red carpet for Al-Sisi, but demand change during Wednesday's summit: No human rights improvements, no EU money.
That's our message to @vonderleyen.ec.europa.eu ๐
Legally, the EU Treaties explicitly prevent such a shutdown - the existing budget continues to apply until a new budget is agreed

๐ฃ Bottom line:
The current ruling doesnโt kill ๐ฎ๐น๐ฆ๐ฑ, but makes it more difficult to apply it;
The next ruling will address whether outsourcing detention and removal complies with EU law โ and if legal fictions are enough to guarantee real rights.
To be continued. โ๏ธ
12/
โ ๏ธ Serious doubts remain about whether ๐ฎ๐น can guarantee equivalent standards in Albania,especially concerning:
The right of defense in detention and asylum procedures;
Access to adequate healthcare;
Lawful and justified deprivation of liberty.
Legal fictions โ effective protection.
11/ The Italian court is skeptical.
It argues thereโs a โsufficiently close connectionโ to the EU legal order. So even in ๐ฆ๐ฑ, EU standards must be concretely respected, not just promised on paper.
10/๐ฅ The legal issue:
The Protocol says migrants in Albania should be treated โas ifโ they were on Italian territory.
But EU asylum law formally applies within EU territory.
โก๏ธ Does that legal fiction (voluntary extension) hold up?
9/๐งโโ๏ธ Italyโs Court of Cassation asks:
1๏ธโฃ Can migrants be transferred from ๐ฎ๐น CPRs to ๐ฆ๐ฑ even without a real prospect of return?
2๏ธโฃ If they seek asylum after transfer, can they still be detained?
8/โณBut thereโs more:
This judgment only covers Phase 1 of the ๐ฎ๐น๐ฆ๐ฑ model.
Phase 2, the transfer of detainees already in Italy to Albania, is being reviewed in a separate case pending before the EU Court.
7/ In fact, the future EU Regulation could make this even easier: โก๏ธ Accelerated border procedures will also apply to people from countries with a recognition rate below 20%, not just โsafeโ countries of origin.
01.08.2025 10:46 โ ๐ 1 ๐ 0 ๐ฌ 2 ๐ 06/โSo, is the Italy-Albania deal dead? ๐ Not necessarily. The ruling doesnโt address Albania or external processing directly. So yes, transfers may still happen, if criteria are met today (meaning designation with no exceptions) or may resume in the future, once the APR enters into application.
01.08.2025 10:46 โ ๐ 2 ๐ 0 ๐ฌ 1 ๐ 05/๐ Importantly, the Court also looks to the upcoming Asylum Procedures Regulation, which (once in force) will:
Allow safe country designations by law;
Permit exceptions, both:
๐น Personal (vulnerable groups), and
๐น Territorial (unsafe regions).
4/๐งพ Applicants must have access to the sources used to justify the countryโs safety. Judges must also have access, and may consider additional (reliable) sources. ๐ซ No shortcuts or assumptions.
01.08.2025 10:46 โ ๐ 2 ๐ 0 ๐ฌ 1 ๐ 0๐ Key takeaways from the Court:
โ๏ธ Safe countries can be designated by law;
โ๏ธ The designation must be judicially reviewable and based on solid, up-to-date info;
โ๏ธ It canโt currently apply if specific groups (e.g. women, minorities, LGBTI) face risks in that country, as the APD doesn't allow it.
2/ This ruling concerns only the first phase of the ๐ฎ๐น๐ฆ๐ฑ model: the border accelerated procedure for asylum seekers coming from "safe" countries, and transferred to Albania after being rescued on the high seas. โ ๏ธ It does not related to Albania or external processing directly.
01.08.2025 10:46 โ ๐ 2 ๐ 0 ๐ฌ 1 ๐ 01/๐งตWhat did the EU Court of Justice actually say about "safe countries of origin"? And what does it mean for the ๐ฎ๐น๐ฆ๐ฑ Italy-Albania migration deal? Letโs break it down: thread ๐
