I'm fine with the subscription for the other services, not one that requires a physical object that becomes useless if you aren't paying or if the service shuts down. They should've added a 2D mode or have the games come with the accessory to own.

The process has been discussed by their comms.
In the government phases, all sides would be present to debate and catch things, including the video games lobby who will be fighting to get the imitative dismissed or law weakened as much as possible. I doubt the SKG side would want oversteps too.

Ways of complying include:
-Offline modes.
-Releasing server software.
-Open peer to peer connections to route yourself.
-Selling the game as a subscription instead or making it free, matching that the product is a service. Microtransactions do still aim to be protected though.

If companies don't want to release source code, they'd plan out something that doesn't require that. Yes, this stuff will require extra work to transition industry practice over, but we wouldn't have any regulations at all if that was a dealbreaker.

Middleware companies wouldn't need to provide the tooling or source code to the players. Just as they have their tooling implemented in a compiled game that people play, the same applies to compiled server software. Licenses to prevent unauthorized use would still exist.

2. SKG would not be retroactive. 99% of Dreamcast games are SKG compliant already cause they aren't online only!

It's a case of them not wanting to, not that it's not possible. If console makers don't budge to allow connecting to 3rd party servers or whatever other solution, they'd miss out on getting those games at all on their platform and the revenue cut from them.

Games designed with SKG in mind wouldn't be needing to talk to devkits in the first place because consumers obviously don't have access to that. The situation would be impossible, failing SKG compliance and thus wouldn't be made like that. Server software doesn't need to be open source either.
