I believe that Congress has tried to address this! In 2022, they passed Electoral Count Reform Act, which basically clarified that the VP’s role is actually “solely ministerial” and that they can’t reject electors. www.nytimes.com/2023/10/26/u....

The part about the Senate and House needing to approve the VP could definitely be something where one of the parties could act in bad faith. Can’t imagine either of the major parties doing THAT though, of course

I -think- this falls under the 2nd section of the 25th amendment: “Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.”
