In short; The court didn't think that the perpetrator using his fingers to fondle her and penetrate her vagina was enough for the rape to be considered aggravated rape, so he was sentenced to 3 years in prison for rape. Aggravated rape would have been needed for him to be deported.

I wouldn't spread misinformation, the police have nothing to do with the courts decision. The prosecutor asked for the perpetrator to be deported but 3 of the 4 lay judges decided against that.

I think he should have been deported, he doesn't deserve refugee status.
