Qualified immunity is a concept that came out of the judiciary post-emancipation. They were too cowardly to convict violent racist officials and the concept settled into American law and expanded to where we see it today.

every single successful general strike in US history has had union backing through the local AFL-CIO

this is the first time itโ€™s been called for since the 1940s

I think Carney should "look into" the use of the Magnitsky Act for the Venezuela boat strikes and illegal ICE raids.

The part everyone should be concerned about is that any competent analyst could have told him that.

Exactly how far has Trump isolated himself from expertise? What does that mean for future policy decisions impacting not just America, but the world?

#ClimateChange deniers be like "it's a hoax".

FFS, the planet would be -18ยฐC (0ยฐF) without greenhouse gases and we've added 50% more.

You think it's not going to have an impact?

If you were comfortable at two blankets and someone added a third, would you still be comfortable? How about two?

It's dementia, hubris, and blinders.

I don't think he even realizes the money and power he'll personally lose instantly. American strategic losses would take generations and trillions to recover from.

The only way he could come out ahead would be to end democracy in America.

Black bowl showing a broccoli and Beyond Steak spears

I tried the Beyond Steak "plant-based seared tips" today. 226g package is about CDN $11. Probably enough for three meals. Taste is like beef. Mouth feel is somewhere between fatty chunks of beef and yuba. I stir-fried it with broccoli, garlic, onions, mushroom sauce, and tamari.

I ate too much. ๐Ÿ˜‹

Hey America.

When you helped Israel do aweful things to Palestinians without consequence, you created a culture of permission - that the strong may kill the weak because they can.

That permission is spreading -

to America.

In my job, we often try to quantify risk using probability and severity, and I find it really unintuitive. I wonder if there could be better communication on this.

Maybe it's about risk perception. The chance of getting hit by lightning is low, but the outcome can be fatal. And we _do_ often see news saying that climate scientists or the IPCC underestimated this or that. Even if the consensus isn't changing that much, it's a bit alarming.

So yes, Canadaโ€™s system is different. But the real reason ICE is so awful isnโ€™t modern politics or incompetence. Itโ€™s that parts of U.S. law were built to SURVIVE EQUALITY WITHOUT ENFORCING IT โ€” and theyโ€™re still doing their job.

That retreat hardened into doctrine. Each time rights enforcement threatened the social order โ€” Reconstruction, civil rights, mass policing โ€” courts raised shields. Qualified immunity is the legal memory of that fear.

After emancipation, Congress empowered courts to punish state officials who abused power. Southern officials resisted. Violence followed. Rather than fully enforce equality, courts narrowed remedies, softened liability, and insulated officials.

So where did that instinct come from? It didnโ€™t appear out of nowhere. It emerged when the U.S. first tried to hold officials accountable for violating the rights of a newly freed population โ€” and the courts panicked.

13.12.2025 05:54 โ€” ๐Ÿ‘ 0    ๐Ÿ” 0    ๐Ÿ’ฌ 1    ๐Ÿ“Œ 0

Canada never adopted this doctrine. There, the assumption is: if the state violates your rights, the state answers for it. In the U.S., the assumption quietly became: officials must be protected from the people.

13.12.2025 05:54 โ€” ๐Ÿ‘ 0    ๐Ÿ” 1    ๐Ÿ’ฌ 1    ๐Ÿ“Œ 0

Enter qualified immunity. In the U.S., officials arenโ€™t liable unless they violate โ€œclearly establishedโ€ law. Novel abuses donโ€™t count. Courts dismiss cases before evidence is heard. Impunity isnโ€™t a bug โ€” itโ€™s engineered.

13.12.2025 05:54 โ€” ๐Ÿ‘ 0    ๐Ÿ” 1    ๐Ÿ’ฌ 1    ๐Ÿ“Œ 0

The U.S. model is different. ICE does visible interior policing. Wrongful arrests rarely lead to meaningful consequences. Even clear rights violations often go unpunished. This isnโ€™t just culture โ€” itโ€™s law.

13.12.2025 05:54 โ€” ๐Ÿ‘ 0    ๐Ÿ” 0    ๐Ÿ’ฌ 1    ๐Ÿ“Œ 0

Canada still detains and deports people. But enforcement is mostly administrative: hearings, reviews, court oversight. Officers and the state can be sued. Abuse happens โ€” but the system is designed to be checked, not theatrical.

Why doesnโ€™t Canada have an immigration agency like ICE? We enforce immigration law, but without routine raids, โ€œpapers pleaseโ€ policing, or an agency that seems to operate above the law. It looks like Canada is just more reasonable.

Composition fallacy. Youโ€™re cherry-picking one drawback to ignore the full-system benefits.

Next step will be "moving the goal post" fallacy.

Letโ€™s face it, ICE vehicles are
probably a part of your identity and you're resistant to the change.

Drive one. You might like it.

TL;DR: Dems made a coordinated move to end shutdown but risk giving up power if they treat short-term deals as wins. GOP's internal chaos is deliberate - it shifts power toward the exec and weakens Congress. The fight is really about whether democratic institutions or Trump chaos controls the purse.
