Qualified immunity is a concept that came out of the judiciary post-emancipation. They were too cowardly to convict violent racist officials and the concept settled into American law and expanded to where we see it today.

So yes, Canadaโs system is different. But the real reason ICE is so awful isnโt modern politics or incompetence. Itโs that parts of U.S. law were built to SURVIVE EQUALITY WITHOUT ENFORCING IT โ and theyโre still doing their job.

Canada still detains and deports people. But enforcement is mostly administrative: hearings, reviews, court oversight. Officers and the state can be sued. Abuse happens โ but the system is designed to be checked, not theatrical.

Why doesnโt Canada have an immigration agency like ICE? We enforce immigration law, but without routine raids, โpapers pleaseโ policing, or an agency that seems to operate above the law. It looks like Canada is just more reasonable.
