True. I suppose I should add there is another constraint: the size of SCOTUSβs docket. But I donβt want to dismiss the disconnect between what the legal establishment says law is and what the general public perceives it to be. Their sense is grounded in a lot of uncomfortable truths.

One thing many prominent attorneys dismiss is the degree to which constitutional law is, well, whatever five votes on the Supreme Court say it is. The only constraint on their behavior is norms. Motivated reasoning can get around any legal roadblock when youβre the final arbiter of what laws mean.
