Friends of the Earth Canada v. Canada (Attorney General) - Federal Court

Good to see Safe Food Matters et al continuing to demand accountability from PMRA in relation to the licensing of glyphosate-based pesticides in Canada.
And I expect this decision by Justice Zinn to become a leading authority on review of decisions w/out supporting reasons.

Among other impacts on Canadian law with respect to Indigenous consultation, this will mean grappling more meaningfully with the Indigenous nation's laws & customs, as well as deeper thinking over the proper representatives of the rights holders. Here are some key paragraphs.

The Commission erred in deciding it lacked jurisdiction to consider how UNDRIP impacts the Crown's duty to consult & accommodate the First Nation over a proposed Near Surface Disposal for nuclear waste near Chalk River, Ontario. Now it will have to go back & reassess the adequacy of consultation.

Yukon could get a new Indigenous-led protected area as big as Vancouver Island. The Ross River Dena Council, Yukon and Canada are studying protections for caribou habitat in an area where both the landscape and the Kaska people have been disturbed by colonization. thenarwhal.ca/ross-river-d...

Canada strangely argues at the ICJ that the right to life is not informed by the environment and the 'content' of the right to a clean, healthy and sustainable environment is 'undefined'. Also argues that the principle of prevention does not exist in the field of climate change.

Why 34 years ago?

Neil Stonechild was arrested by two #Saskatoon police officers & left in a field northwest of the city on Nov 25, 1990.

Neil was found by construction workers 34 years ago today, frozen to death.

Among other things, the majority judgment has an interesting synthesis of principles elaborated in relation to the Crown's duty to consult and treaty infringement in past cases, including with respect to identifying credible but unproven rights claims and damages. Lots to unpack.

Expanding on lower court cases about other unique contractual arrangements like Treaty Land Entitlement agreements, the majority says the Honour of the Crown applies when Crowns contract with Indigenous peoples as collectives to address Indigenous difference and credibly claimed Indigenous rights.

The Supreme Court of Canada just released a fascinating new decision on the Honour of the Crown. Building on a recent case on legislative reconciliation in the child and family services context, it has outlined a complementary framework for contractual reconciliation: www.scc-csc.ca/case-dossier...
