Percolating morning coffee thoughs Law school was the first time I encountered the Federalist Society. I knew I didn't share their views on strict construction of the Constitution, but I didn't think of them as a cult. Under the Dollar Store Dictator, it's clear that they don't respect anything about the Constitution and the rule of law. They support violating due process and the right to counsel, engaging in unlawful searches and seizures, abridging freedom of speech and of the press, freedom of assembly and the separation of church and state. We already know that our first amendment rights have been eroding for decades, but the cornerstone of our rights in the justice system is that, through precedent-some of it being interpreted by strict constructionist justices-the courts have evolved and we don't have kangaroo courts like the ones that sentenced my Dakota ancestors to death in less than a day without due process or the right to counsel after the Dakota Uprising. I always explain to my clients that due process means that you have the right to counsel, to have someone who can slow things down, explain what is happening to you and that you get contest it even if you loose. In the American legal system, you are owed an explanation of why you are being detained and a quick review by a judge as to your detention. Once due process is eliminated en mass for immigrants, regardless of their status, it can be eliminated en mass for any of us. This is why we all need to care about what is happening to so called illegal immigrants.
