I wanted to email directly to say that the premise of the consultation is wrong.

1) I do not understand why the loss-making and environmentally disastrous AI sector is being treated as somehow of equal value to the creative sector, which constitutes 5% of the UK GDP and a far greater amount of our soft power. The creative industries are this country's flagship. Why does this survey treat the two as equivalent in importance?

2) This consultation is loaded towards the opt-out model, whereby the AI developers can use copyrighted work unless prevented, and the administrative burden for this is to be put on the creator This is a bewildering choice. Why is the onus on the owner of the work to prevent it being taken against their will? Are we moving to a model whereby we can all take other people's possessions unless they've filled out a "Please Don't Steal My Things" form in advance, or is it just the AI industry that's excused from property rights?

I do not accept the premise that the tech sector should be able to have whatever it wants as a default. As such, this consultation is deeply flawed.

I also do not see why there is even a need for a consultation when the existing legal principle is clear. If companies wish to use copyrighted work, they must license it from the copyright holder and agree payment for it. That's how publishing works. Publishers can't simply publish an author's work if they haven't filled in an opt-out form. The onus is on the publisher (audiobook producer, TV company, graphic novel creator, toy manufacturer) to agree a deal with the copyright holder and pay compensation for the use of their work. There is no reason this should be different for tech companies.

Are intellectual property rights no longer to be protected in the UK? Why is this consultation floating the idea of making copyright protection optional and difficult to obtain? And why is a Labour government so keen on taking away people's rights to the fruits of their labour?

I emailed copyrightconsultation@ipo.gov.uk directly to summarise my thoughts on the bullshit consultation with its bullshit proposal.

tl;dr: Why is this consultation loaded towards "the law shouldn't apply to scammy tech bros"?

Copyright and Artificial Intelligence This consultation seeks views on how the government can ensure the UK’s legal framework for AI and copyright supports the UK creative industries and AI sector together.

UK WRITERS: You need to fill in this consulation. Govt is very clearly looking to an opt-out model of rights licensing that puts all the burden on creators instead of profiteers. It's long and boring but this is important.

a digital painting of Alecto in profile wearing an orange Edwardian era dress with a high white collar and red cravat, a small hat and white gloves. she also has barbie-like star shaped earrings. her hair is pinned back. she's sitting in an ornamental wooden chair with one hand propping up her chin and the other holding a sword. on the floor next to her there are cattle skulls and scattered pieces of bone. her eyes are glowing gold

Francis Crozier reclines fetchingly on the Arctic shale on his side posed like Dr Ian Malcolm with one arm resting on his raised bent knee but in full battered-looking cold weather naval slops and with a little sun protector tucked under his hat. Somebody else is bending down next to him and a few other people are milling around in the background. The eternal reminder:

SATURDAY CHILLIN’

Don’t fucken @ me
