These consolidated cases are about the limits of the President's power to dictate the rules of federal elections. The Framers of our Constitution recognized that power over election rules could be abused, either to destroy the national government or to disempower the people from acting as a check on their elected representatives. See, e.g., The Federalist No. 59 (A. Hamilton); Federal Farmer No. 3. Accordingly, they entrusted this power to the parts of our government that they believed would be most responsive to the will of the people: first to the States, and then, in some instances, to Congress. See U.S. Const. art. 1, § 2, cl. 1; U.S. Const. art. 1, § 4, cl. 1. They assigned no role at all to the President. Put simply, our Constitution does not allow the President to impose unilateral changes to federal election procedures. Upholding our Constitution's separation of powers in the election context is a matter of substantial importance. The Supreme Court long ago recognized that the right to vote is a "fundamental political right" because it is "preservative of all rights." Yick Wo v. Hopkins, 118 U.S. 356, 370 (1886). Our Constitution's careful allocation of power over election regulation helps to preserve that bedrock right. Now pending before this Court are several pending cross-motions for summary judgment implicating these important principles. Plaintiffs mount a variety of challenges to Executive Order No. 14,248, in which the President has purported to direct several changes to federal election procedures. Upon consideration of the parties' submissions,' the relevant legal

authority, and the entire record, the Court shall GRANT IN PART, DENY IN PART, and DEFER IN PART each of the parties' motions and shall DISMISS certain claims in part. Because the record in these cases continues to evolve, many of these denials and dismissals shall be without prejudice. The Court shall DECLARE that two provisions of the Executive Order-both purporting to impose new requirements for verifying the U.S. citizenship of people registering to vote or applying to receive absentee ballotsare inconsistent with the constitutional separation of powers and cannot lawfully be implemented. The Court shall PERMANENTLY ENJOIN the relevant Defendants from taking any action to implement or give effect to those provisions. The Court shall also DECLARE that, in the course of implementing provisions of the Executive Order that call for federal agencies to access and share sensitive personal data, the Federal Defendants must strictly comply with the requirements of the Privacy Act, 5 U.S.C. § 552a. Finally, the Court shall direct the parties to propose a schedule for further proceedings.
